Welcome to NC Promo. By accessing our website, requesting a quote, placing an order, or purchasing products from NC Promo, you agree to the following Terms & Conditions.
1. Acceptance of Terms
By using our website or purchasing products from NC Promo, you agree to these Terms & Conditions. If you do not agree, please do not use our website or services.
2. Quotes & Pricing
All quotations are valid for 30 days unless otherwise stated.
Pricing is subject to change due to:
- Supplier price changes
- Material costs
- Freight increases
- Tariffs or government fees
- Changes in product specifications
- Quantity adjustments
Prices are not guaranteed until an order has been accepted by NC Promo.
3. Orders
An order is considered accepted only after:
- A written approval is received from the customer.
- Artwork or proof approval has been received (when applicable).
- Any required deposit or payment has been received.
NC Promo reserves the right to decline any order.
4. Artwork & Proof Approval
Digital proofs are provided for customer review prior to production.
It is the customer’s responsibility to carefully review all proofs for:
- Spelling
- Grammar
- Dates
- Contact information
- Colors
- Logo placement
- Product selection
- Quantities
- Sizes
Once a proof has been approved, the customer assumes responsibility for all approved content.
Changes requested after approval may result in additional charges or production delays.
5. Product Renderings & Mockups
Product renderings, digital mockups, and promotional images are intended for visualization purposes only.
Actual products may vary due to:
- Decoration methods
- Material characteristics
- Production tolerances
- Product size
- Screen resolution
- Manufacturing variations
Logo size and placement shown in preliminary mockups are approximate unless specifically identified as a production proof.
6. Colors
Every effort is made to accurately reproduce colors.
However, slight color variations may occur due to:
- Monitor settings
- Printing methods
- Embroidery
- Dye lots
- Fabric materials
- Manufacturing processes
Exact color matching cannot always be guaranteed.
7. Production Times
Estimated production times begin after:
- Artwork approval
- Order approval
- Payment requirements have been satisfied
Production schedules are estimates only.
NC Promo is not responsible for delays caused by:
- Manufacturers
- Shipping carriers
- Weather
- Customs
- Supply shortages
- Events beyond our reasonable control
8. Shipping
Shipping dates are estimated.
Risk of loss transfers to the customer upon delivery to the shipping carrier unless otherwise required by law.
Customers should inspect shipments immediately upon arrival.
9. Custom Products
Because most products are custom manufactured, decorated, embroidered, engraved, printed, or personalized:
Custom orders are generally non-returnable and non-refundable unless the product contains a verified manufacturing or decoration defect or does not conform to the approved proof.
10. Cancellations
Orders canceled after production has begun may be subject to:
- Artwork charges
- Setup charges
- Production costs incurred
- Restocking fees (when applicable)
Custom products already produced cannot be cancelled.
11. Payment Terms
Payment terms will be specified on the quotation or invoice.
Late payments may be subject to finance charges permitted by applicable law.
NC Promo reserves the right to suspend production on unpaid orders.
12. Returns & Claims
Claims regarding shortages, defects, or shipping damage should be reported within five (5) business days of delivery.
NC Promo may require photographs, product samples, or other documentation before processing a claim.
13. Intellectual Property
Customers represent that they own or have permission to use all logos, trademarks, artwork, and other materials submitted to NC Promo.
The customer agrees to indemnify and hold NC Promo harmless from claims arising from unauthorized use of submitted materials.
14. Limitation of Liability
To the fullest extent permitted by law, NC Promo shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our products or services.
NC Promo’s maximum liability shall not exceed the amount paid for the affected order.
15. Force Majeure
NC Promo shall not be responsible for delays or failure to perform caused by circumstances beyond our reasonable control, including natural disasters, labor disputes, transportation interruptions, government actions, pandemics, supplier shortages, or similar events.
16. Website Content
All website content, including text, graphics, logos, photographs, and design, is the property of NC Promo unless otherwise noted and may not be copied or reproduced without written permission.
17. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.
18. Changes to These Terms
NC Promo may update these Terms & Conditions from time to time.
